A tilted Kilt Suitcase Lawsuit

The lawsuit filed by a woman who was wrongfully killed in an accident that occurred while she was wearing a kilt has been turned into a UK vs. United States case. The claim brought forth against the company manufacturing the particular kilt which is responsible for her death was a defective and unsafe design which should have been identified and corrected prior to the manufacture of the kilt. The claim was for personal injury compensation as well as compensation for her loss of companionship, and her suffering. She had been riding on a sloping hill behind her home wearing her kilt on the day of her accident, but the slope caused her body to slip from the kilt into the stream of water which was running below her.

The injuries from her injuries resulted in a fractured vertebrae, left shoulder pain, neck pain, back pain, permanent brain damage, and a loss of companionship which she would have received had she not been wearing her kilt on that day.

The accident was ruled in favor of the defendant because it was ruled that the slope which caused the accident was an element of probability. They were also found to be negligent and liable for the injuries sustained by the plaintiff. A three-year statute of limitations was imposed on filing this lawsuit.

This is just one of the many cases that are being filed in an effort to hold companies accountable for their actions.

There have been several tilted kilt lawsuits filed against the makers and distributors of the kilt. It appears that these lawsuits are not only in response to one woman’s tragic accident but are being filed by women who have been similarly injured due to defective products. These lawsuits bring awareness to the dangerous and unsanitary conditions which are often found to exist in the mines and pits where manufactured goods are processed and disposed.

The lawyer for the plaintiff in this case is expected to win her lawsuit, due to the evidence that is present.

There have been previous cases which have proven the dangers of wearing a tilted kilt. These cases include one in which a woman died after slipping out of her house while wearing the item. This lawsuit has brought about changes in the way people wear these items.

The lawyer will need to prove that the manufacturers knew about the hazards associated with these clothing when they produced them. She will also have to show that there was a direct negligence on the part of the manufacturer which resulted in this situation. In addition to proving liability, she will have to show that monetary damages have resulted from her suffering and will allow her to obtain compensation for past and future medical costs, pain and suffering, and loss of earnings. This case is currently one which is still ongoing and has no current time limit.

Another interesting side note from this lawsuit is the fact that the company whose manufacturing product is at issue produces one of the most expensive kilts available on the market. Although it was manufactured in Scotland, the company moved the manufacturing to New Zealand. The Tilted Kilt is also known as the “Kiltie” or “Stumpy” and is one of the most popular personalized kilt designs currently available. If you are wondering if you may have a case like this, you should contact a personal injury lawyer who may be able to tell you if you have a potential case.
