A Mazda Class Action Lawsuit Could Be Approved

Two Florida residents allege in a recent Mazda class action lawsuit that their car models contain defective new smart braking systems that activate unexpectedly without warning. The class vehicles include a new feature called i-activated safety technology, which consists of passive safety electronics and electronic pre-crash stability technology, which are intended to help prevent and minimize the likelihood of accidents, while the car is on the road. The plaintiffs say that they have suffered personal injury and property damage as a result of the recalled cars and have filed a lawsuit against the automaker. They are asking for compensatory and punitive damages. The trial date is scheduled for later this year.

A number of other auto manufacturers and brands have been caught or are currently facing class action lawsuits for recalls involving driver safety issues over the years.

In recent years, several different manufacturers, including General Motors, have faced significant fines and even been forced to recall their vehicles. In addition to cars, trucks, and SUV’s, manufacturers have recalled trucks, boats, ATVs, dirt bikes, and motorcycles. There are a number of Class Action lawsuit settlements between car and truck manufacturers and drivers, who suffer injuries because of faulty cars. These lawsuits are often very significant and allow drivers to seek financial compensation for injuries and lost wages.

The plaintiffs in the Mazda case, along with some others, say that they purchased cars from various dealerships including Mazda, without having any idea that the braking system was defective.

When they had accidents, they said they were unable to prove that the manufacturer was responsible. Plaintiffs argue that the company knew about the defective devices long before they installed them in thousands of vehicles but did nothing to warn them of the risks involved. The manufacturer is being sued by plaintiffs who say they have permanent injuries as a result of being injured in one of their defective cars.

Some of the cars were also involved in an accident where the brakes failed, causing the death of the passenger inside the vehicle. While no monetary damages have yet been awarded by the courts, class members have already received substantial compensation.

Plaintiffs in the case say that the manufacturer did not take reasonable care in testing the vehicles for safety, because they did not consider the potential effects of their defective airbags on their passengers. The manufacturer did introduce one design of defective airbag into the vehicles, but did not make it mandatory for drivers to equip their vehicles with the newer model. The new design allowed the airbags to rupture once they deployed, causing severe and permanent injuries to some of the Class members.

Plaintiffs have alleged that the manufacturers knew about the defective airbags in their vehicles even though they knew or should have known that they were dangerous. Plaintiffs have alleged that the manufacturer of the vehicles knew about the problems with the variable valve timing assembly long before they sold millions of cars containing them. The defendant has said that they are liable because they marketed the vehicles but did not carry out the research that they needed to make sure that the cars were safe. The trial is expected to last at least a few months. If no settlement is reached between the parties, a class action lawsuit could be filed in state court. It is possible that a jury will decide on the case.
