A federal court judge who is presiding over the Yasmin and Yaz lawsuit multidistrict litigation (mdl) issued an injunction order in regards to the distribution of hormone in Ocella pregnancies. Ocella is the generic version of Yaz and acts in much the same way. This particular lawsuit involves claims that the marketed birth control pill has caused low blood levels to increase in infants with developmental disabilities.

The plaintiffs argue that this increased blood flow damages their children’s ability to receive oxygen and nutrients and ultimately causes their death or disability. Ocella manufactures the progestin type of Hormone. It is sold under several brand names, such as Actonel, Ovarian Fluid Support, Synarelle andleva. The complaint states that Ocella failed to warn that the progestin could have dangerous side effects and is the reason for the increase in pulmonary hypertension in infants. These side effects include a decreased lung function, increased pulmonary hypertension and stroke.

Plaintiffs filed a class action lawsuit against Ocella and its subsidiary, Insulin Inc. They are seeking over $1.75 million in claims for their injuries and lost wages. This represents a substantial amount in settlement funding. Ocella has filed its own lawsuit in state court and is expected to file additional claims in state courts throughout the country.

The Federal District Court for the Northern District of Texas has scheduled a conference on December 13th to determine if there is a class of plaintiffs entitled to damages in the case of the Ocella lawsuit. If no settlement is reached, then additional motions will be filed in this matter. The parties involved are scheduled to meeting again on February 8th to continue negotiations. Whether this meeting will result in any settlement remains to be seen, but it is looking as if both sides may proceed with this litigation.

Plaintiffs have alleged that they sustained injuries as the result of Ocella’s negligence in selling the HMO’s along with failing to provide adequate compensation for these injuries. Plaintiffs further allege that they were injured as a direct result of the defendants’ policies, which they knew or should have known resulted in serious injury and sometimes death. The financial loss associated with these injuries has also been a contributing factor to the lawsuit. It is not known what monetary compensation the plaintiffs will receive in this litigation. Whether this monetary settlement is enough to cover their attorney fees and medical expenses is still being debated in court.
