Januvia Lawsuit: A Closer Look at the “Jujvin” Case

The Jammu and Kashmir government has announced that they are going to file a lawsuit against theaceutical company, Abundra, for their role in the Enviro Diagnostic Centre (EDC) case. This is the case where the government ordered an extensive inquiry into whether or not the company provided substandard healthcare services to their patients.

In the past, the company has come under fire for not providing quality health care standards, with many patients taking to plastic surgery to correct what the hospital staff perceived as deficiencies in the health of their client.

The details of the lawsuit itself are as detailed as they can get. The complaint was filed by the State of Jammu and Kashmir and the Law Commission of India, after the FDA (Food and Drugs Administration) received a complaint regarding the manner in which Suboxone was dispensed to a patient in Jammu and Kashmir.

Suboxone was prescribed to this patient, who was referred to a psychiatrist on a psychiatric care unit, for an addiction to alcohol. After the medication was completed, and the patient was discharged from the hospital, it was found that the EDC used substandard measures in treating the patient.

Suboxone was one of the drugs most frequently prescribed for persons suffering from addiction to alcohol or other substances.

The FDA had received complaints that some Jammu and Kashmir government doctors had been using it as a money making ‘scam’ to extort money from drug-dependent patients.

The charges in this case were that the doctor, through prescribing Suboxone, had issued instructions to a nursemaid that if the patient did not follow these instructions, the doctor would issue orders for compulsory quashing of the patient’s prescription. The charges in this case further added that the EDC did not have adequate documentation to show that the prescriptions were issued on an approved basis.

The government intends to use this case to educate other institutions such as nursing homes and hospitals, in how to handle similar situations.

They state that they will sue every other medical institution that acts in a similar manner as the EDC has done. If the lawsuit proceeds, they hope that it can reduce the number of drug-induced injuries or deaths in the state. They also believe that if enough cases are brought forth, it could make the healthcare industry more accountable to their patients.

However, the plaintiffs in this case feel differently.

They claim that the entire case against them is politically motivated. They are basically accusing the government of trying to placate the population and boost their popularity at the same time. The judge will make a decision soon, and the date is yet unknown.

Some may view this situation with cynical eyes, considering the fact that a government body does not need to be accountable to anyone, particularly the person who ordered its actions.

This is one scenario where we can see a parallel between human rights and the universal laws of nature. The ruling party will always have some vested interests in the process. This is why we have to take the matter into our own hands when our rights are being trampled on. We have to fight for our rights, regardless of which road we are taking.
